The Turkish competition authority initiated an investigation about several companies operating in iron and steel market

The Turkish Competition Board initiated an investigation about several companies operating in iron and steel market namely Kardemir Karabük Demir Çelik San. ve Tic. A.Ş., Çağ Çelik Demir Çelik Endüstri A.Ş., Çelsentaş Çelik Mamulleri San. ve Tic. A.Ş., Yolbulan Demir San. ve Tic. A.Ş. and Yolbulanlar Nakl. ve Tic. A.Ş.. The decision initiating the investigation was taken following annulment of an earlier decision of the Competition Board (dated 27.1.2011 and numbered 11-06/101-34) by the Council of State. In its decision dated 27.1.2011 and numbered 11-06/101-34, the Competition Board closed the case as there was no evidence that the relevant companies acted in concert to avoid operating in each other's markets, to share sources of raw materials and to fix the price for raw materials. Moreover, the Competition Board dismissed the allegations regarding abuse of dominant position as the relevant company Kardemir Karabük Demir Çelik Sanayi ve Ticaret A.Ş. was not dominant in the relevant market for billet. Finally, allegations regarding failure to notify an acquisition were dismissed due to rules regarding statute of limitation. The Council of State annulled the decision of the Competition Board on the grounds that it was based on incomplete examination. The Competition Board took into account the decision of the Council of State and decided to initiate an investigation.
