ICN Cartel Workshop, organized by the ICN Cartel Working Group, was hosted by the Spanish Competition Authority on 3-5 October 2016 in Madrid, Spain. Yüksel Kaya, Advisor at ENRE, acted as one of the discussion leaders during the breakout session entitled Achieving Procedural Fairness/Due Process in Cartel Investigations whilst Maintaining Efficiency and Effectiveness. During the Cartel Workshop, three plenary meetings were held on the topics of investigative strategies and techniques; challenges regarding public and private enforcement; and sanctions and tools for deterrence.
In addition to plenary sessions simultaneous mini plenary sessions and breakout sessions were held. Various topics were covered during those simultaneous sessions such as achieving an efficient and effective leniency; formal tools for detection of cartels such as dawn raids; tools to fight bid-rigging cartels; challenges related to evidence gathering after dawn raids; the use of indirect evidence in cartel cases; triggering factors and strategy in making leniency application; settlement; extra-territorial antitrust enforcement; developments and challenges regarding private enforcement; procedural fairness in cartel investigations; international coordination in multijurisdiction cartel investigations; sanctions, remedies and damage redress; interaction between cartel enforcement and the fight against corruption; considerations and methodologies in setting fines; and compliance activities and priorities.
