Yüksel Kaya from ENRE moderated the Breakout Session on Refusal to License Intellectual Property during 2016 ICN Annual Conference

The 2016 ICN Annual Conference was held between 25 - 29 April in Singapore. Yüksel Kaya (Director, Competition and Regulation at ENRE) Moderated the Breakout Session on Refusal to License Intellectual Property organized by the Unilateral Conduct Working Group.

After his presentation, Terence Seah, Senior Assistant Director at Competition Commission of Singapore, shared his views concerning when a patent holder was considered to hold a dominant position; Kentaro Hirayama, Counsel at Morrison & Forrester, mentioned the circumstances under which a patent holder was required to grant license; Joseph Matelis, Special Counsel at Sullivan & Cromwell, addressed the remedies applicable to deal with refusal to licence cases, and finally Munesh Mahtani, Senior Competition Counsel at Google, cited practical considerations in examining refusal to license from European perspective. The break out session ended after the participants discussed a hypotethical case involving refusal to licence.
